These Terms of Use ("Terms") govern your access to and use of the PlanEx flashcards and study application for iOS and the PlanEx web service (together, the "Service"). Please read them carefully before using PlanEx.
This summary is provided for convenience only. The complete Terms below govern your use of PlanEx.
By creating a PlanEx account, clicking an acceptance control where presented, or purchasing a paid PlanEx product, you agree to these Terms. Except where PlanEx expressly requires one of those actions before allowing further use, continuing to use the Service after being presented with these Terms also constitutes agreement. If you do not agree, do not use the Service.
These Terms form an electronic agreement between you and PlanEx. The current version is available at:

You may save, download, or print these Terms for your records. Where applicable law requires additional pre-contract information, affirmative acceptance, or confirmation on a durable medium, PlanEx will provide or obtain it as required.

PlanEx has chosen, as a Service eligibility rule, to make the Service available only to users aged 16 and older. You must be at least 16 years old to create and use a PlanEx account. This PlanEx eligibility rule is separate from any different age threshold that may apply under local privacy, contract, or consumer law.
If you are 16 or older but have not reached the age at which you may independently enter into these Terms where you live, you must have the permission of your parent or legal guardian where such permission is required by applicable law.
PlanEx does not currently provide a parental-consent mechanism for users under 16. Persons under 16 may not create or use a PlanEx account.
You may not use the Service if applicable law prohibits you from doing so.
PlanEx requires an account for account-based features. When creating or maintaining an account, you must provide accurate information and keep it reasonably up to date.
You are responsible for safeguarding access to your account and for activity that occurs through your account to the extent caused by your failure to protect your account or connected authentication credentials. You must notify PlanEx promptly at planexhelp@outlook.com if you believe your account has been accessed without authorization.
PlanEx supports Google Sign-In and Sign in with Apple. PlanEx does not provide a separate PlanEx e-mail-and-password login. Your use of Google or Apple authentication is also subject to the applicable provider terms. If you use Sign in with Apple and choose Hide My Email, Apple may provide PlanEx with a private relay e-mail address instead of your ordinary e-mail address.
PlanEx is an educational productivity and study Service for creating, organising, and studying flashcards and related learning materials. The PlanEx hierarchy is Card → Module → Folder: a Card is an individual study card; a Module is a collection of Cards; and a Folder is a collection of Modules.
PlanEx may provide study schedules, repetition logic, statistics, reminders, progress tracking, formatting tools, image support, export functionality, and other features designed to support learning. PlanEx Cards is a centralized catalog through which PlanEx makes pre-made Modules available to users.
The iOS application supports PlanEx purchases. The web version provides PlanEx functionality to eligible Pro users but does not itself accept PlanEx Pro purchases. A Pro entitlement purchased through the iOS application may be recognized on the web when you sign in to the corresponding PlanEx account.
Features may vary by device, operating system, country or region, account type, app version, subscription status, and technical availability.
PlanEx is an educational productivity tool. It does not provide professional educational, medical, legal, financial, or other regulated professional advice.
PlanEx offers free functionality and paid features under PlanEx Pro. The specific features included in the free version and PlanEx Pro are those described in the Service and on the Apple purchase screen at the time of purchase.
PlanEx may change features available in the free version from time to time. For paid products, PlanEx will not intentionally remove the core paid benefit during a prepaid subscription period without providing any notice or remedy required by applicable law.
PlanEx Pro is offered through the Apple App Store as a monthly auto-renewable subscription and an annual auto-renewable subscription. Purchases are made through Apple in the iOS application; PlanEx does not currently accept PlanEx Pro purchases through the web version.
Before you confirm a subscription purchase, Apple displays the applicable subscription title, duration, price, currency, and any eligible introductory offer or free-trial terms. Those purchase-screen terms form part of your agreement for that purchase.
Monthly and Annual subscriptions renew automatically for successive subscription periods until cancelled. Apple may charge your selected payment method before or at renewal in accordance with Apple’s rules and the terms shown on the purchase screen.
You can manage or cancel an App Store subscription through your Apple account settings. Cancellation stops future renewal but normally does not terminate access for the remainder of a period already paid for, unless applicable law or Apple provides otherwise.
The Annual PlanEx Pro subscription includes a three-day free trial for users who are eligible for that offer and for whom Apple displays the trial on the purchase screen. The Monthly subscription and Lifetime purchase do not include this three-day trial.
Unless you cancel the Annual subscription before the free trial ends in accordance with Apple’s rules, the subscription will automatically convert to a paid annual subscription and Apple will charge the annual price shown when you started the trial. If Apple does not display the free trial because you are not eligible for it, the Annual subscription may be charged immediately when you confirm the purchase.
Any other introductory price, promotional offer, or promotional code is subject to the eligibility, duration, region, account, and other conditions displayed by Apple or PlanEx before purchase.
PlanEx may offer a one-time non-renewing product described as Lifetime access. The Lifetime product is charged once through the Apple App Store and does not automatically renew. It does not include a free trial.
“Lifetime” means a one-time entitlement to the PlanEx Pro features included in that product for as long as PlanEx continues to make the applicable Service and those features available, subject to these Terms and any mandatory consumer rights or remedies that apply if the Service is materially changed or discontinued.
Prices may vary by country, currency, taxes, and available Apple offers. The final price displayed by Apple before you confirm the purchase is the price applicable to that transaction.
Apple processes payment credentials and issues the App Store transaction. PlanEx does not receive or store your full payment-card number, card security code, or other complete payment-card credentials. PlanEx may receive and store limited purchase and entitlement information needed to verify the purchase and provide paid access, such as the product purchased, transaction identifier, purchase and expiration dates, trial status, subscription or entitlement status, and refund or cancellation status where Apple makes that information available.
If Apple changes the price of an auto-renewable subscription, any required notice, consent, renewal, or cancellation rights will be handled in accordance with applicable law and Apple’s platform rules.
PlanEx purchases are billed through the Apple App Store and refunds are generally handled through Apple. You may request a refund through Apple where Apple’s rules or applicable law allow.
Deleting your PlanEx account does not automatically cancel an active App Store subscription. If you do not want future renewals, you must separately cancel the subscription through your Apple account settings.
Nothing in these Terms limits any mandatory refund, withdrawal, cancellation, conformity, repair, replacement, price-reduction, or other consumer right that cannot lawfully be waived.
Consumers in Armenia may have a statutory right to withdraw from certain distance contracts within 14 days without giving a reason, subject to the conditions and exceptions provided by Armenian consumer law. Where service performance begins during a withdrawal period at the consumer’s request, payment may be due for the proportion of services already provided where the law permits. Statutory exceptions may apply, including where a service has been fully performed with the consumer’s prior consent and acknowledgment of the consequences for the withdrawal right.
“User Content” includes Cards, Modules, Folders, notes, text, images, formatting, and other study materials that you independently create, enter, upload, edit, or store through PlanEx. As between you and PlanEx, you retain ownership of your original User Content.
You are responsible for ensuring that you have the rights and lawful basis necessary to upload, store, and use your User Content and that your content and use of it comply with applicable law and these Terms.
You grant PlanEx a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and technically modify User Content only to the extent reasonably necessary to operate, secure, synchronize, support, back up, troubleshoot, and improve the Service and to provide features you request.
This license ends when the relevant User Content is permanently deleted from PlanEx systems, except to the limited extent that residual copies remain temporarily in processor backup or recovery systems or retention is required by law, as described in the Privacy Policy.
“PlanEx Content” means pre-made Modules, Cards contained within those Modules, explanations, examples, images, layouts, and other learning materials made available by PlanEx through the Service, including through the PlanEx Cards catalog.
You may add a PlanEx Module to your account, study it, edit it for your own learning, and export it where the Service permits. Adding, editing, or exporting PlanEx Content does not transfer ownership of the underlying PlanEx Content or any third-party rights in it to you. You retain ownership of original material that you independently add to or create within a copied PlanEx Module.
PlanEx grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use PlanEx Content for lawful personal study and learning. Except where PlanEx expressly permits otherwise or applicable law provides otherwise, you may not resell, sublicense, commercially distribute, or commercially exploit the underlying PlanEx Content.
PlanEx may allow you to export User Content or PlanEx Content in supported file formats. Once a file is exported outside PlanEx, copies may be stored, shared, or processed outside PlanEx’s control. Exporting content does not expand the intellectual-property rights granted under these Terms.
PlanEx respects intellectual-property rights. If you believe that content made available through the Service infringes your copyright or other intellectual-property rights, contact planexhelp@outlook.com and provide enough information for PlanEx to identify the material, understand the claimed right, and contact you. PlanEx may request additional information reasonably necessary to assess the claim and may remove or restrict access to material where appropriate or required by law.
You must use PlanEx lawfully and responsibly. You may not:
PlanEx does not proactively monitor or review private User Content. PlanEx may, however, access, review, remove, preserve, or restrict access to specific User Content where reasonably necessary to comply with applicable law or a valid legal request, respond to a credible report of a violation of these Terms, investigate security or abuse, or protect the rights, safety, or security of PlanEx, users, or third parties.
Where required by applicable law, PlanEx will cooperate with competent authorities and comply with legally binding reporting or preservation obligations relating to unlawful content.
PlanEx and its software, design, interfaces, logos, trademarks, algorithms, documentation, and PlanEx Content, to the extent protected by applicable intellectual-property law, are owned by or licensed to PlanEx or otherwise used lawfully. These Terms do not transfer those rights to you.
Subject to these Terms, PlanEx grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for lawful personal study and learning purposes.
No rights are granted except those expressly stated in these Terms or required by applicable law.
Your use of PlanEx may depend on third-party services, including Apple, Google, Firebase, Google Cloud, device operating systems, internet providers, and other infrastructure providers. You must comply with applicable third-party terms when using those services.
PlanEx is not responsible for third-party services, outages, payment systems, or policies that PlanEx does not control, except to the extent responsibility cannot lawfully be excluded.
You may stop using PlanEx at any time. You may also permanently delete your PlanEx account as described below.
PlanEx may temporarily restrict or suspend access where reasonably necessary to protect account or Service security, investigate suspected fraud or abuse, comply with law or a binding legal request, address a serious breach of these Terms, or protect PlanEx or other users.
Where reasonable and legally permitted, PlanEx will provide notice and an opportunity to address the issue before permanent termination. Immediate action may be taken where necessary for security, unlawful conduct, serious harm, or compliance with a binding legal requirement.
Termination does not remove any mandatory refund or consumer remedy that applies under law.
You may initiate account deletion from within the PlanEx application. PlanEx may ask you to confirm or re-authenticate the request to protect the account from unauthorized deletion.
Once you confirm account deletion, the account is permanently closed and the deletion cannot be reversed or undone. Your PlanEx account, Cards, Modules, Folders, study progress, learning history, and other associated User Content that is deleted cannot be recovered or restored through PlanEx.
PlanEx deletes or anonymises associated account-linked data that is no longer required, subject to limited legal retention and processor deletion or backup cycles described in the Privacy Policy. Residual copies that may temporarily remain in processor backup or recovery systems are not used by PlanEx to restore a permanently deleted account.
If you later register again using the same Google or Apple account or the same e-mail address made available through that provider, the new registration is treated as a new PlanEx account and previously deleted User Content and study data will not be restored.
Deleting your PlanEx account does not automatically cancel an active Apple App Store subscription. You must cancel the subscription separately through Apple if you do not want future renewals.
PlanEx processes Personal Data in accordance with its Privacy Policy. The Privacy Policy explains the Personal Data PlanEx processes, Google and Firebase services used by PlanEx, Apple purchase verification, international transfers, analytics and diagnostics, retention, account deletion, marketing choices, and your privacy rights.
The Privacy Policy is available through the PlanEx website, the Service, and the applicable app-store listing.
PlanEx may update the Service to improve functionality, security, compatibility, performance, or legal compliance. Some updates may be required to continue using the Service.
PlanEx aims to keep the Service available but cannot promise uninterrupted or error-free operation. Maintenance, network failures, third-party outages, security incidents, or circumstances beyond reasonable control may temporarily affect availability.
PlanEx may change or discontinue features where reasonably necessary. If a material change adversely affects a paid Service during a prepaid period, PlanEx will provide any notice, continued access, refund, price reduction, or other remedy required by applicable law.
PlanEx uses study schedules, repetition logic, statistics, reminders, and other learning tools to support study. Learning performance depends on many factors outside PlanEx’s control.
PlanEx does not guarantee that you will remember particular information, pass an exam, achieve a grade, meet a deadline, obtain a qualification, or reach any other educational outcome. You remain responsible for your study decisions and for verifying important academic requirements and deadlines.
To the maximum extent permitted by applicable law, and subject to any mandatory consumer guarantees, PlanEx is provided on an “as available” basis. PlanEx does not make warranties that the Service will always be uninterrupted, error-free, or suitable for every individual study objective.
Nothing in these Terms excludes or limits warranties, guarantees, conformity rights, or other protections that applicable consumer law does not permit PlanEx to exclude or limit.
To the maximum extent permitted by applicable law, PlanEx will not be liable for indirect, incidental, special, punitive, or consequential losses, or for loss of profits or business opportunities, arising from use of the Service where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence where such limitation is prohibited, violation of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.
Where a limitation of direct monetary liability is legally permitted, PlanEx’s aggregate liability arising out of the affected paid Service will not exceed the amounts you paid for that paid PlanEx product during the 12 months preceding the event giving rise to the claim, whether the payment was made through the Apple App Store or another authorized channel that PlanEx may lawfully make available in the future. This limitation does not apply where applicable law requires a greater remedy.
These Terms are governed by the laws of the Republic of Armenia, without prejudice to mandatory consumer-protection rules that apply to you in your country of residence.
Before starting formal proceedings, PlanEx encourages you to contact planexhelp@outlook.com so that PlanEx can try to resolve the issue directly. This does not limit your right to bring a claim before a competent court, regulator, consumer authority, or other forum available under applicable law.
Consumers in Armenia may also use applicable complaint mechanisms of the Competition and Consumer Protection Commission of the Republic of Armenia. Information is available at https://competition.am.
If you are a consumer, nothing in these Terms deprives you of any mandatory right to bring proceedings in a court or forum available under the law applicable to you.
If you download PlanEx through the Apple App Store, the license to the iOS application is also subject to Apple’s applicable App Store terms and the Apple Standard End User License Agreement unless a separate custom EULA is expressly provided through the App Store.
PlanEx, not Apple, is responsible for operating the PlanEx Service and for support relating to PlanEx, subject to applicable law. Apple processes App Store purchases and subscriptions under its own terms and policies.
You must comply with applicable Apple Media Services and App Store terms when using PlanEx on Apple devices.
PlanEx may update these Terms to reflect changes to the Service, business model, legal requirements, security needs, or operational practices.
If a change materially affects your rights or obligations, PlanEx will provide reasonable advance notice where required by applicable law, for example through the Service, website, or e-mail. Where applicable law requires new affirmative acceptance or consent for a particular change, continued use alone will not substitute for that required action.
Changes will not retroactively reduce rights relating to a completed purchase where doing so would violate applicable law. The Effective Date at the top identifies the current version.
These Terms, the Privacy Policy, and any purchase-specific terms presented to you form the agreement governing your use of PlanEx, together with any mandatory platform terms that apply.
If a provision of these Terms is found unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect, unless applicable law requires otherwise.
If PlanEx does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.
You may not transfer your PlanEx account or contractual rights to another person without PlanEx’s consent, except where applicable law provides otherwise. PlanEx may transfer these Terms in connection with a lawful reorganisation, sale, or transfer of the business, subject to applicable consumer and data-protection law.
